1. Acceptance of Terms

By creating an account or using BrainBattle, a product of KodeGuy (Pty) Ltd (“we,” “us,” or “our”), you agree to these Terms of Service. If you do not agree, do not use the service.

2. What BrainBattle Does

BrainBattle is an AI-powered learning platform that turns your own study material — uploaded as PDF documents — into personalised quizzes, podcast-style audio summaries, and cartoon-style visual lessons. It also supports teacher-led classes through Battle Squads and family-managed child learner profiles.

3. Eligibility and Age Requirements

You must be at least 18 years old to create a self-managed account on BrainBattle (Student, Adult Learner, or Teacher account type). By registering, you confirm that you are 18 years of age or older. You are required to check an age confirmation box at registration — this confirmation is legally binding.

Anyone under 18 may use BrainBattle only through a Parent/Child profile, created and managed by a parent or legal guardian who is themselves 18 or older. No individual under 18 may create a self-managed account directly — whether registering independently or arriving via a teacher’s class invitation link. A teacher invitation does not verify age and cannot be used to bypass this requirement.

At the time each child profile is created, the parent or guardian must affirmatively confirm — via a mandatory checkbox — that they are 18 years of age or older and that they are the parent or legal guardian of that specific child. This confirmation is required for every new child profile added to the account.

BrainBattle also complies with the U.S. Children’s Online Privacy Protection Act (COPPA). Because our self-registration age (18) is higher than COPPA’s minimum (13), no child under 13 can ever self-register under any circumstance. See our COPPA Compliance Statement for full detail.

4. Subscription and Billing

BrainBattle offers paid subscription plans. By subscribing, you authorise us to charge the applicable subscription fee on a recurring basis (monthly or annual) through our payment processor, PayFast. All prices are displayed in USD. PayFast handles currency conversion and payment processing — BrainBattle does not store your card details.

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period.

5. Your Content and Uploaded Material

You retain ownership of any PDF documents or other study material you upload to BrainBattle. By uploading content, you grant KodeGuy a limited licence to process that content for the sole purpose of generating your quizzes, podcasts, and cartoon lessons. We do not use your uploaded material to train AI models for any other purpose.

You are responsible for ensuring that any material you upload does not infringe third-party intellectual property rights.

6. Acceptable Use

You agree not to:

• Provide false information at registration, including false age confirmation
• Allow a person under 18 to use a self-managed account you created
• Attempt to circumvent age verification or access controls
• Upload unlawful, harmful, or infringing content
• Attempt to reverse-engineer, scrape, or interfere with the platform
• Use the platform for any commercial purpose beyond your own personal learning or classroom use

7. Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately at support@kodeguy.com if you suspect unauthorised access to your account.

8. Limitation of Liability

To the maximum extent permitted by applicable law, KodeGuy (Pty) Ltd shall not be liable for any indirect, incidental, or consequential damages arising from your use of BrainBattle. The platform is provided “as is” without warranties of any kind.

9. Termination

We reserve the right to suspend or terminate your account if you breach these Terms of Service. You may delete your account at any time from your account settings.

10. Changes to These Terms

We may update these Terms of Service from time to time. Continued use of BrainBattle after changes are posted constitutes your acceptance of the revised terms.

11. Governing Law

These Terms of Service are governed by the laws of South Africa, without regard to conflict of law principles. For users in other jurisdictions, mandatory consumer protection rights under local law continue to apply.
